Off-Duty Recreational Cannabis Use [Practical Law The Journal]

Ed Langhammer contributed to the March edition of the GC Agenda about California law AB 2188. This law prohibits discrimination against an employee or applicant for off-duty and off-premises cannabis use. California is the latest state to enact a law to protect the employment rights of recreational cannabis users. Employers can and should still have policies prohibiting employees from possessing, using, or being impaired by cannabis while on duty or in the workplace, including working remotely.
