2022 Business Bankruptcy Practice

David Doyle, Allen Guon, and Peter Roberts each authored a chapter in the 2022 edition of Business Bankruptcy Practice, a book published by the Illinois Institute of Continuing Legal Education. The book serves as a comprehensive guide to business bankruptcy, covering the consequences of bankruptcy and out-of-court alternatives, the trustee's responsibilities and avoiding powers in business bankruptcies, involuntary bankruptcy, and more. 

In Chapter 6, "Advising Business Debtors: Alternatives to Bankruptcy," David explores some strategic alternatives available to a distressed company outside formal bankruptcy proceedings. He covers the advantages and disadvantages of workout alternatives while analyzing shutdown alternatives. 

In Chapter 10, "Representing the Chapter 11 Debtor," Allen provides an overview and introduction to Chapter 11 from the point of view of the debtor and debtor's counsel. Allen points out the first steps and goals for those filing a Chapter 11 case and explains the process to achieve the best outcome.

In Chapter 18, "Asset Sales Under the Bankruptcy Code," Peter provides insight on the Bankruptcy Code §363 process and discusses fundamental asset sale concepts. In this chapter, he also articulates the relevant standards governing the sale of assets under the Bankruptcy Code.
