Creditor's Rights Chapter on Equitable Remedies Available to Judgment Creditors [Illinois Institute for Continuing Legal Education]

Jeff Greenspan, Jonathan Walton and Corey Hickman, have co-authored a chapter (chapter 4) in the Illinois Institute for Continuing Legal Education (IICLE) publication titled "Creditor's Rights - 2019 Edition." The chapter outlines several equitable remedies available to a judgment creditor to reach assets that rightfully should be available to satisfy a judgment against a debtor. The guide provides best-practice assistance for attorneys dealing with creditors’ rights issues and includes discussion of new Supreme Court Rule 280. Chapter topics include: collection actions; enforcement of judgments; enforcement of security interests and liens on personal property; equitable remedies; replevin, detinue, and attachment; claims and remedies against defunct corporations, partnerships, and unincorporated associations; the Fair Debt Collection Practices Act (FDCPA); bankruptcy; eviction and distress for rent; and registration of judgments and registration of foreign judgments, federal judgments, and judgments entered in another county in Illinois.
