Alison Lecker, an associate in Cozen O’Connor’s Utility, Environmental & Energy Practice Group, discusses the Chesapeake Bay Total Maximum Daily Load, a cleanup plan established by the U.S. Environmental Protection Agency in The Legal Intelligencer. The TMDL establishes limits on nitrogen, phosphorus, and sediment, as well as setting compliance milestones in order to meet water quality standards for dissolved oxygen, water clarity, bay grasses, and chlorophyll-a. The Chesapeake Bay Program, a regional partnership that includes the EPA and the other TMDL jurisdictions has determined that agriculture is the largest source of nutrient and sediment contamination entering the bay.
