Steve KatkovElizabeth Olivera, and Jon Schoenwetter will speak at the Minnesota Cannabis Real Estate Summit hosted by REjournals.

 

Steve will moderate “Understanding Differences in Cannabis and Real Estate Financing.” He will guide the panel in discussing a state-by-state analysis of cannabis license collateral, the complexity of equity pledges and legal opinions in cannabis financing, applicable law reps and warranties, and compliance with law covenants. The panel will also address topics such as landlord rights, tenant indemnity, collateral assignment of leases to cannabis lenders, legal opinion requirements, and leasing considerations for cannabis license holders.

 

Elizabeth will present “Legislative Updates for Employers.” She will discuss the implications of cannabis legalization on workplace drug testing policies and how to ensure alignment with current legislation. Additionally, she will provide insight into Minnesota’s ban on post-employment noncompete clauses and best practices for moving forward, cover restrictions on non-disparagement and confidentiality agreements, and review the state-wide implementation of earned sick and safe time and legislative developments regarding paid family and medical leave.

 

Jon will present “Navigating Dispensary Locations: Compliance with Zoning Ordinances and State Statutes.” He will cover zoning and land use regulations, compliance with cannabis statutes and municipal ordinances, and various site control approaches including aggressive, conservative, and moderate strategies. Additionally, Jon will address letters of intent, due diligence processes, sensitive uses, distance requirements, and cannabis-specific contingencies. He will also provide an update on the current legislative and regulatory landscape in Minnesota following the 2024 session, including insights on timing, the number and types of licenses, what licensees can do, and expectations from local municipalities moving forward.
