Anna Wermuth will speak on the “Testing Certification through Litigation” panel at the American Bar Association's 17th Annual Labor and Employment Law Conference. Anna will discuss Ex-Cell-O, the 50-year-old board case that established a prospective bargaining order as the only remedy for an employer’s unlawful refusal to bargain, and whether and/or how the “testing cert” process is fundamentally flawed.
