Gary Gassman will present on a panel titled “Recent Developments Concerning Molestation Claims” at the ABA Tort Trial & Insurance Practice Section’s 2022 Section Conference in Baltimore, Maryland.
The presentation will provide a background of the law regarding molestation claims and describe the types of claims being made. The panelists will discuss the increase in claims and the types of insurance policies implicated; analyze select policy terms, the number of occurrences, and trigger; and discuss theories of liability. On the reinsurance side, the panel will speak about the insurer’s determination of the number of occurrences or events; notice issues; aggregation and allocation; and “follow the fortunes”/ “follow the settlements” provisions in reinsurance contracts
