Richard J. Maleski will present “Countering Cyber Attacks Through Subrogation: A Guide to Assessing Claim Viability” at the American Bar Association’s Fidelity & Surety Law Midwinter Conference. Richard will present alongside Dr. Ronald Menold of COSECURE, and Rebecca Barton of Cowbell Cyber Insurance. This panel will outline how to analyze the viability of subrogation for cyber claims, such as computer fraud. More specifically, the presentation will address key issues the attorney or claims handler should consider in order to effectively evaluate cyber claims in the subrogation context, including identifying potential targets, assessing causes of action, and looking at industry and legal standards that may influence courts.
