Part two of this recorded CLE webinar continues a review of the rules, procedures, and case law for the introduction of social media evidence into trial. Panelists discuss ways to preserve, produce, and admit evidence and the potential challenges that may be encountered when handling this category of evidence, which is constantly evolving in technology and use.
Electronic discovery, the preservation and production of electronically stored information (ESI), is typically done during the discovery phase of litigation and can be one of the costliest stages in any given case. ESI can be located on devices such as computers and laptops to wearable technology and random-access memory “RAM.” Panelists discuss types of content that is stored on social media platforms, how it is stored, and the duty to preserve this evidence, which does not change when the evidence in question comes from social media sites.
