Richard Mason, a member in the firm's Global Insurance Department, and Alexandra Schultz, an associate in the Global Insurance Department, will present a webinar titled, "Coverage under E&O and D&O Policies for Claims Against Insureds by Governmental Entities."Actions brought against insureds by governmental entities often present complex and challenging coverage questions. This presentation will explore the most frequently asserted types of claims, including but not limited to civil investigative demands and subpoenas, False Claims Act liabilities, Securities Act violations, and the recent wave of opioid litigation asserted by states, counties, and municipalities. The presentation will address specific coverage questions that often arise, such as determining when a “claim” was first made as defined by the policy and the applicability of relevant exclusions. In addition, the presenters will provide practical tips for obtaining important information from the insured and public sources.
