Hosted by the Loss Executives Association, Elliott Feldman, co-chair of our Subrogation & Recovery department, will moderate the "Pursuing Legal Action against Foreign Governments for Acts of International Terrorism" workshop presented by Sean Carter and J. Scott Tarbutton. This workshop will provide an overview of the statutory framework and underlying claim scenarios for pursuit of aggregated subrogation opportunities against governmental entities involving national and international casualty losses. The program will provide the background of the $10 billion plus subrogation claim being pursued on behalf of the insurance industry against Saudi Arabia and sponsors of terrorism arising from the 9/11 terrorist attacks; the pursuit of claims against the federal government resulting from the deemed taking of properties damaged by Hurricane Katrina as a result of the government's failure to have maintained the shipping channel known as MR-GO; the pursuit of expropriation claims against the government of Cuba; and international cyber losses caused by intentional hacking under the auspices of foreign governments. 

William Walsh will speak on the topic of "Technology and Insurance Claims." Technology is advancing quickly and while these technologies have real and practical applications in the claims world there are potential limitations imposed by law, privacy and application. Managing the effective use of these technologies and avoiding related legal issues can be difficult. The purpose of this discussion is to identify new technology currently being used and those technologies on the horizon. The panel will also be discussing some very challenging issues with the safe operation, use and deployment of these technologies.
