Gratz CLE Series - Summer 2008

This course will examine the ongoing legal efforts to hold the Kingdom of Saudi Arabia and other alleged sponsors of al Qaeda liable for injuries resulting from the September 11th attacks. Course instructors Stephen A. Cozen and Sean P. Carter, two of the attorneys leading the legal effort on behalf of the Plaintiffs, will review the background of the litigation and provide a thorough discussion of the jurisdictional and substantive theories for the claims advanced in the Multi-District Litigation, including the factual predicates for those claims. Among other topics, the course will explore potential theories for establishing jurisdiction over foreign states in terrorism cases under the Foreign Sovereign Immunities Act and the parameters of substantive liability for terrorism sponsorship claims under the Anti-terrorism Act. Common law conspiracy and aiding and abetting theories will also be addressed.
